The website is in the Czech language. The promoted food supplements are intended for a wide range of health issues. To place an order and subsequently purchase the food supplements, the consumer must add the product to the shopping cart, which then triggers a window prompting them to fill out a contact form. The consumer is then contacted by phone by an operator to confirm the order and to verify whether the purchased product is suitable for the consumer. The consumer is subsequently informed by phone of the alleged effects of the chosen food supplement. Although the consumer specifies the desired quantity of the product during the ordering process, they are later pressured over the phone to purchase a higher quantity at a significantly higher price than originally intended. Additionally, the price of the ordered product does not match the price stated on the promotional website. The order is confirmed by phone and delivery details are provided.
What to watch out for:
1) The products create the impression of being medicinal products, which is reinforced by the inclusion of the Czech Chamber of Pharmacists’ logo in the illustrative image of the product. However, they are in fact food supplements, i.e., food products.
2) The website includes so-called therapeutic claims, which are prohibited in connection with food products, in violation of Article 7(3) of Regulation (EU) No. 1169/2011 (e.g., protection against heart attacks or reduction of heart attack risk), as well as unauthorized health claims, which violate Regulation (EC) No. 1924/2006 (e.g., blood pressure regulation, cholesterol level optimization).
3) The website lists existing brick-and-mortar pharmacies along with their contact information (e.g., BENU Pharmacy Milovice, Italská or BENU Pharmacy Lysá nad Labem, Masarykova), although this is done without the knowledge of those pharmacies.
4) The website states that the company is allegedly located at Bulevard Corneliu Coposu 7, Prague 030167, Czech Republic. However, this is a fictitious address.
5) The website does not provide terms and conditions or truthful information about the seller, and this information is not disclosed during the phone call during which the distance contract is concluded, nor is it included in the received order.
6) The website unlawfully uses the addresses, phone numbers, and email addresses of brick-and-mortar pharmacies operated by Milovická lékárna s.r.o. and Šporkova lékárna s.r.o.
7) The website in question is registered outside the territory of the Czech Republic, and the domain name holder is from Vietnam.
8) The activities of the Czech supervisory authorities towards the operator of this website are very limited.
